A 10-year-old girl was in tears and cried on the witness stand on Wednesday as she recalled the night a man known to her allegedly touched her genital area.
Trial is underway before Superior Court of Guam Presiding Judge Alberto Lamorena for defendant Jeffrey Guerrero Cruz who is accused of sexually assaulting three girls and a boy known to him.
Cruz is represented by attorney Rocky Kingree.
Assistant Attorney General Sean Brown called the girls to testify on Wednesday.
The 10-year-old child wiped tears from her eyes as she recalled what happened the night she alleges she was sexually assaulted.
She was doing her homework when the defendant asked if he could help. "He said come lay next to me," the girl said.
She testified the defendant was touching her genital area.
“I tried to stop him but he just kept touching. ... I lied to him and said, ‘Can I go use the restroom?’ Before I went to the restroom, he pulled me down and said, 'Are you ok?' I said, 'Yes I'm fine.'"
The child's parents, who weren't home when the sexual assault allegedly occurred, were called. The prosecution played the phone recording in the courtroom. Her parents could be heard telling the child they are sorry for what happened and that they were on the way home.
"He touched me a lot of times – when I was in first and second grade," she said of the defendant, who had been babysitting some of the children. The girl is now in fourth grade.
“I was scared (to tell anyone)," she said. “I was afraid my dad would go to jail, because he may do something bad" to the defendant.
'You better not tell'
A second girl was called up by the government to testify on Wednesday.
The 12-year-old girl alleged the defendant sexually assaulted her at least 10 times over the past two years.
"He would touch my private parts," she said, as she recalled the last alleged incident occurred while the defendant was babysitting her and her siblings at his house.
She said she was sitting on his bed watching TV, and her siblings went to the restroom when the alleged incident happened.
"I was scared. I said, 'I need the restroom' but he said, 'You better not tell or else something is going to happen,'" the 12-year-old stated.
The second girl said she only spoke up after her sister came forward about the alleged sexual abuse.
The girl also said Cruz would bounce her on his lap and molest her.
Cruz was arrested in May 2018 after the allegations surfaced.
He was charged with seven counts of second-degree criminal sexual conduct.
Court documents state a third female victim, 12, told police Cruz had sexually assaulted her sometime in 2017, when she was in a bedroom. She told police she became scared, exited the room and ran home.
A 7-year-old boy also told police that in August 2017, Cruz called him into the kitchen, where Cruz allegedly touched the boy's private parts.
The trial is expected to continue Thursday.
